Chamisa , 42, who lost the 2018 presidential vote to President Emmerson Mnangagwa and refused to join political talks with the president over the country’s economic crisis and ways to solve the intractable political disputes stemming from that election in the absence of a foreign mediator. Recently the Supreme court declared that the process that made Chamisa acting party president after Morgan Tsvangirai died in February 2018 was illegal and therefore null and void , making Chamisa an illegitimate leader, I repeat that any opposition groups, rebel groups, activists or other, who fail to unite with others in fighting the Corona Virus, do so at the risk of losing popularity and being seen as being partisan to the people’s suffering as we all know this virus will cause massive losses of human life. Eventually when normalcy is restored, nations need to rebuild life, put people back in employment, restart their economies and generate growth and development.
It is public opinion that Chamisa suddenly went quiet and knowing that internal opponents in MDC want his fall as they feel his rise was unconstitutional, Khuphe and Komichi and Mwonzora along with many key people also wanted the unconstitutional rise reversed, meaning Chamisa can only start building a party from nothing, no structures, no buildings, no funding, clearly irrelevant at the eleventh hour and all previously fired people, mayors and others across the country were reinstated as Komichi reversed all dismissals by Chamisa. These recently reinstated community leaders at grassroots level, people with influence, always felt deceieved by Chamisa and are now celebrating true democracy after the reinstatement of democratic principles. Chamisa now has no choice but to seek relevance by attempting to suddenly work with Mnangagwa and the public can see through such,…Politics is a dirty game!
The Supreme Court has confirmed the High Court’s decision that declared MDC-Alliance’s Nelson Chamisa an illegitimate leader of the opposition party after he wrestled power a few hours after the death of founding leader, Mr Morgan Tsvangirai.
The ruling comes after Chamisa had appealed against the ruling by High Court judge, Justice Mushore which nullified his presidency, in 2018.
The judgment nullified Chamisa’s appointment as the leader of the opposition MDC party and also nullified the appointment of both Nelson Chamisa and Elias Mudzuri as vice presidents of the party.
The appointments were made by the late founding leader Mr Tsvangirai in 2014.
In a judgment that has potential of bringing commotion in the party now riddled with disharmony, Justice Bharat Patel yesterday ruled that Chamisa was unlawfully appointed as the acting president of the opposition party.
He upheld the lower court’s position saying it was unimpeachable.
The court observed that Dr Thokozani Khupe was the genuine acting president of the party at the time of Tsvangirai’s death, and restored the status quo.
The judge directed Dr Khupe , who was being represented by Professor Lovemore Madhuku, to convene an extra ordinary congress within three months to elect the party’s new president.
“It is accordingly ordered that the appeal be and is hereby dismissed with no order as to costs,” said Justice Patel.
“The third respondent, (Dr Khupe) in her capacity as the Acting President of the first appellant (MDC), be and is hereby ordered to convene an extra-ordinary congress, within a period of three months from the date of this order, in order to elect a new President.
“In the event that the third respondent fails or is unable to comply with . . . the above, the third appellant (Morgan Komichi), in his capacity as the national chairperson of the first appellant (MDC), be and is hereby ordered to convene the aforesaid extra-ordinary congress, within a period of four months from the date of this order.”
In his ruling, Justice Patel held the view that the corrective intervention of the superior court in the affairs of the party was a matter of significant public importance, not only in relation to the party and its members but also as regards the governance of political parties generally.
This will be a long road, case in point, the British government has already indicated, today that UK over the last 24 hours, Britain had 761 Corona Virus deaths, bringing the death toll to 12,568, and that the nation will have 2 million unemployed people soon, and from the look of things, they are not ready to relax the lockdown emergency laws, due to be reviewed on Thursday 16/04/20. I say, it is important for everyone to put the interests of the people and nation wherever they are and unite to rebuild the nations. For Zimbabwe, these two Chamisa and Mnangagwa working together will help the two find each other and rebuild the nation.
